Independent expert opinion

An expert’s role is to assist the court on matters within their expertise. That duty overrides any obligation to the instructing or paying party.

Opinions must distinguish fact from assumption and identify material uncertainties. Acceptance does not imply support for a particular position.

Further work

Supplementary reports, responses to questions, expert discussions, conferences and court attendance should be identified so scope, availability and fees can be agreed separately.
